By accessing or using Timeexa, users agree to these Terms & Conditions. If a user does not agree, they should not use the application or related services.

1. Acceptance of Terms

These Terms & Conditions govern the use of the Timeexa mobile application, web portal, biometric attendance services, APIs, dashboards, reports, and related services provided by AVSG Info Systems Pvt. Ltd.

2. Authorized Use

Timeexa is intended only for employers, employees, administrators, managers, and authorized users of registered organizations. Unauthorized access or misuse is strictly prohibited.

4. Attendance Verification

Attendance may be verified using GPS, selfie, face recognition, biometric device, RFID/card, QR code, mobile device ID, IP address, or other methods configured by the employer. The employer decides which attendance rules and verification methods apply.

5. Employer Authority

The employer or organization is responsible for defining attendance policies, shift timing, leave rules, holidays, overtime rules, geofence rules, approval workflows, payroll rules, and employment-related decisions. Timeexa only provides the software platform and related technical services.

6. Accurate Information

Users must provide accurate information and must not submit false attendance, fake location, manipulated selfie, incorrect data, or unauthorized entries. Any misuse may result in action by the employer according to their internal policy.

7. Service Availability

Timeexa services may depend on internet connectivity, GPS availability, mobile device performance, biometric device connectivity, cloud server availability, power supply, telecom network, and third-party services. Temporary interruptions, delays, or errors may occur.

8. Data Accuracy and Verification

Attendance records, reports, and payroll-related outputs should be reviewed and verified by the employer before making salary, payroll, compliance, disciplinary, or business decisions. Users should report incorrect attendance or discrepancies to their employer promptly.

9. Limitation of Liability

To the maximum extent permitted by applicable law, AVSG Info Systems Pvt. Ltd. provides Timeexa on an “as is” and “as available” basis. We do not guarantee that the service will always be uninterrupted, error-free, accurate, or available at all times.

Financial Loss Disclaimer:
AVSG Info Systems Pvt. Ltd. shall not be liable for any financial loss, salary dispute, payroll error, business interruption, loss of profit, employment dispute, tax liability, statutory penalty, contractual claim, or any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of Timeexa, except where such liability cannot legally be excluded under applicable law. Employers are solely responsible for verifying attendance, payroll, and compliance data before taking any financial or employment-related action.

10. Third-Party Services

Timeexa may integrate with third-party services such as SMS, WhatsApp, email, maps, cloud hosting, biometric devices, payment systems, payroll systems, APIs, and notification services. We are not responsible for failures, delays, inaccuracies, or losses caused by third-party services.

All software, source code, designs, logos, trademarks, content, workflows, reports, and related intellectual property of Timeexa belong to AVSG Info Systems Pvt. Ltd. or its licensors. Users are not granted ownership rights.

13. Suspension or Termination

Access may be suspended or terminated if the user violates these Terms, employer policy, contractual terms, applicable law, or security requirements.

14. Force Majeure

We are not responsible for failure or delay caused by events beyond reasonable control, including natural disasters, server outages, cyberattacks, internet failure, power failure, government action, strikes, telecom failure, or third-party service failure.

15. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Subject to applicable law, disputes shall be subject to the jurisdiction of courts located in Lucknow, Uttar Pradesh.

16. Changes to Terms

We may update these Terms from time to time. Continued use of Timeexa after changes means acceptance of the updated Terms.
